1. Definitions

“Platform” means the website and services offered at mybusinessdraft.com.
“Credits” means the digital tokens sold by P3ak that entitle the holder to generate one (1) Business Plan per Credit.
“Digital Content” means AI‑generated business plans and related exports produced by the Platform.
“Refund” means a reversal of a qualifying payment to the original payment method or another method accepted by P3ak.
All other capitalised terms have the meanings set out in the Terms & Conditions.

2. Scope & Application

This Policy applies to all one‑time credit purchases, paid feature unlocks, and any other fee‑based transactions conducted on the Platform. It supplements the Terms & Conditions and prevails in the event of conflict solely with respect to refunds, cancellations, and chargebacks.

3. Cooling‑Off & Statutory Withdrawal Rights

3.1 European Union / United Kingdom (14‑Day Digital Withdrawal)

Under the EU Consumer Rights Directive and UK Consumer Contracts Regulations, consumers ordinarily have 14 days to withdraw from distance contracts. However, when digital content not supplied on a tangible medium is delivered immediately after purchase with the consumer’s express consent and acknowledgment of waiver, the right to withdraw is lost.
By completing a payment on the Platform you (a) request immediate provision of Credits and Digital Content, and (b) expressly waive the statutory withdrawal right.
Nevertheless, P3ak voluntarily offers the unused‑credit refund described in § 4.1.

3.2 South Africa (7‑Day CPA Direct‑Marketing Cooling‑Off)

If a purchase resulted from direct marketing within the meaning of the Consumer Protection Act 68 of 2008, you may rescind the transaction within 7 calendar days of receipt, provided no Credits have been used. Contact us as set out in § 6.

3.3 United States Federal & State Consumer Laws

P3ak complies with applicable federal and state regulations governing refunds for digital goods. Statutory rights take precedence over this Policy where mandatory.

4. Eligibility for Refunds

Refunds are granted at P3ak’s discretion, subject to verification. The following circumstances are eligible:

4.1 Unused Credits

Condition: All purchased Credits remain unused.
Timeframe: Request within 14 days of purchase (EU/UK/International) or 7 days for direct‑marketing transactions in South Africa.
Refund: 100 % of the purchase price less non‑recoverable payment‑processor fees (if any).

4.2 Technical Failure or Defective Output

If the Platform becomes unavailable or a system error materially prevents generation or export of a Business Plan, and remediation is not possible within 48 hours, unused Credits affected by the incident will be refunded or re‑issued at no cost.

4.3 Duplicate or Fraudulent Transactions

Duplicate charges or verified unauthorised payments will be fully refunded.

4.4 Service Discontinuation by P3ak

If P3ak permanently discontinues the Platform, a prorated refund for unused Credits will be offered.

5. Non‑Refundable Circumstances

Refunds will not be granted for:

  • Credits that have been partly or fully consumed;
  • Dissatisfaction with AI‑generated content quality where generation completed successfully;
  • Failure to meet subjective business outcomes (e.g., investment approval);
  • Purchases older than the timeframes in § 4;
  • Accounts suspended for breach of the Terms & Conditions or this Policy;
  • Free plans, promotional Credits, or bonus allocations.

6. Refund Request Procedure

  1. Submit Ticket: Email support@mybusinessdraft.com or open a ticket via the in‑app support widget with subject “Refund Request”.
  2. Provide Details: Include transaction ID, Paddle receipt, number of unused Credits, and reason.
  3. Identity Verification: P3ak may require verification to protect against fraud.
  4. Evidence: For technical failures attach screenshots or error logs.

7. Evaluation & Approval Process

  • Acknowledgment within 2 business days.
  • Assessment completed within 10 business days.
  • Decision Notice emailed with outcome and next steps.
  • Escalation: Unresolved disputes may be referred to the alternative dispute mechanism in § 13.

8. Refund Method, Currency & Timing

  • Refunds are processed through Paddle, the original payment processor, to the original payment method where possible.
  • Processing times: P3ak initiates approved refunds within 5 business days; posting times depend on your bank/card issuer (typically 5–10 business days).
  • Currency conversions follow Paddle’s prevailing FX rates; foreign‑exchange fluctuations are the customer’s risk.

9. Chargebacks, Payment Disputes & Account Actions

Initiating a chargeback without first following the Procedure in § 6 may result in suspension of your account and forfeiture of Credits. P3ak reserves the right to contest unfounded chargebacks and share evidence with payment networks.

10. Cancellation of Unused Credits & Account Closure

You may request cancellation of your account at any time. Unused Credits are non‑refundable unless § 4 applies. Upon closure, all access to generated content is deleted subject to our Data Retention Policy.

11. Taxes, Exchange Rates & Cross‑Border Payments

Refunds exclude any taxes that are non‑recoverable by P3ak. Where required, tax‑exclusive refunds will be issued, and customers may reclaim taxes from their tax authority. Exchange‑rate differences between purchase and refund dates are not covered.

12. Amendments to This Policy

P3ak may modify this Policy to reflect operational or legal changes. We will provide at least 14 days’ notice via email or in‑app alert. Continued use of the Platform after modifications constitutes acceptance.

13. Governing Law & Dispute Resolution

This Policy is governed by the laws and dispute‑resolution clause set out in the Terms & Conditions. Consumers in the EU/UK may access the European ODR platform. South African consumers may refer disputes to the National Consumer Commission.

  • Assumed Paddle returns non‑recoverable processor fees to P3ak; refund less fees reflected accordingly.

  • No recurring subscriptions; policy reflects one‑time Credits model.
  • Statutory wording may require localisation (e.g., specific state laws in the US or EU member‑state nuances).
  • Recommend legal counsel review for:
  • VAT/GST handling across EU, UK, SA;
  • Brazilian and Canadian consumer laws if targeting those markets;
  • Confirmation of registered address and corporate identifiers.
